Terms of Use

These terms govern how you use the TrashIQ website and platform - whether you are a collector, CBO, county, processor, partner, or visitor.

1. Agreement to Terms

By accessing or using trashiq.africa or any part of the TrashIQ platform, you agree to be bound by these Terms of Use. If you do not agree, do not use the website or the platform.

2. Who These Terms Apply To

TrashIQ is designed for organizations in the waste and circular-economy ecosystem, including:

  • Individual and group waste collectors
  • CBOs and community groups
  • Counties / local governments
  • Processors, recyclers, and material buyers
  • Manufacturers and EPR/ESG stakeholders
  • Donors and impact partners

If you are using the platform on behalf of an organization, you confirm that you have authority to bind that organization.

3. Acceptable Use

You agree to use TrashIQ only for lawful, waste-management–related, and impact-reporting purposes.

You must NOT:

  • Submit false, fabricated, or misleading collection data;
  • Interfere with or attempt to bypass security or access controls;
  • Use the platform to harass, exploit, or expose collectors or communities;
  • Resell access to the platform without a written agreement from TrashIQ / Upeosoft;
  • Upload content that is illegal, harmful, or violates the rights of others.

We reserve the right to suspend or terminate accounts that violate these rules.

4. Data, Attribution & Reporting

A key feature of TrashIQ is attributing waste to the people and groups who actually collected it. To enable this, the data you or your organization submit may be visible to your CBO, county, or program owner.

You are responsible for ensuring that the data you submit is accurate, complete, and authorized for reporting or funding purposes.

We may aggregate or anonymize data for analytics, platform improvement, or circular-economy insights. Aggregated data does not identify you personally.

5. Availability & Changes

We aim to keep the platform available and reliable, but we do not guarantee 100% uptime. We may update, change, or discontinue parts of the service at any time - for example, to add new reports, new material streams, or to improve security.

6. Integrations & Third-Party Services

Some deployments of TrashIQ may integrate with WhatsApp, email services, payment providers (e.g. M-PESA / bank payouts), or government/county systems. Those services are operated by third parties.

Where you choose to connect such services, you are also bound by their terms and privacy policies.

7. Intellectual Property

The TrashIQ brand, UI, dashboards, reports, logos, and platform features are owned by TrashIQ / Upeosoft Limited. You may not copy, rebrand, reverse-engineer, or build a competing service using our content or code without prior written consent.

8. Limitation of Liability

To the fullest extent permitted by law, TrashIQ will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, goodwill, or other intangible losses, resulting from your use of the platform.

If we are found liable, our liability will be limited to the amount you paid (if any) for using the service in the 3 months prior to the claim.

9. Suspension & Termination

We may suspend or terminate your access immediately if we detect abuse, fraud, unauthorized data scraping, security threats, or persistent violation of these Terms. You may also stop using the platform at any time.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable in the Republic of Kenya, without regard to conflict of law principles. Where a project is funded by a partner/donor, specific contractual terms may also apply.
